If you want to be a customer or an active user of our online store, please read our General Terms and Conditions of Use carefully!

Use our services only if you agree with all its points and if you consider all the provisions contained therein to be binding on you.

Contracts are concluded exclusively in electronic form, and concluded contracts are considered written contracts. This document does not refer to a code of conduct.

If you have any questions regarding the operation of the online store, the ordering and delivery process, we are at your disposal at the contact details provided!

  1. Range of products and services available for purchase
    The displayed products can be purchased online with home delivery or personal collection at our pick-up point on working days between 12:00 and 23:00. We also accept orders by e-mail or phone! The prices displayed for the products are gross prices, i.e. they include the statutory sales tax, but they do not include the home delivery fee. We do not charge for packaging.

 

  1. The offered products are classified into the following categories:
    These products are categorized as clothing and accessories.

    The Service Provider displays the name and description of the product in detail on the webshop interface, and displays photos of the products. The images displayed on the product data sheet may differ from the real thing, in some cases they are shown as illustrations.

 

  1. Order information – registration
    Registration is not a condition for purchase. You can decide whether to register for the purchase in our online store. Registration allows you to continuously monitor the status of your order in the online store, and it is also more convenient to choose this option, since you do not have to enter your contact and billing information again and again in the case of new orders.

 

  1. Processing of orders, legal declaration
    Orders are processed on working days until 5:00 p.m. It is also possible to place the order outside of the times marked as processing the order, but if it happens after the end of working hours, then we will process it only on the following working day.

    In all cases, our customer service will confirm electronically or by phone when it can fulfill the order.

    General deadline: within 1-3 working days from confirmation.

Legal Statement:

Although the images displayed on https://japanika.hu/uzlet/ are made of our own product samples, depending on the stock, the images displayed on the product data sheets may differ from the real thing! Our company cannot take responsibility for any changes to the technical specifications, suppliers, or unannounced changes due to reasons beyond its control.

We reserve the right to partially or completely reject orders that have already been confirmed. Partial fulfillment can only take place after consultation with the customer!

Promotional product: The promotional price is valid only during the duration of the promotion, or – if no period is indicated – until stocks last. We recommend that if you order a discount product, you call to inquire about the actual stock. In the event of orders exceeding the stock, we reserve the right to refuse the order.

 

The photos and graphics are owned by JAPANIKA Hungary Vendéglátó Kft. are their property, their use is only permitted after written approval.

The indicated prices do not constitute an offer, we reserve the right to change prices!

We are not responsible for any content errors.

Absentee contracts (e.g. ordering via the Internet) and related cancellation rights are included in 45/2014. (II. 26.) government decree.

 

  1. Order process


The system supports shopping with a virtual shopping cart. You can put the products in this basket according to the real shopping basket, or you can change your mind and remove the items you don’t like. The total value of the basket is continuously visible on the right side of the online store.

To order, you must do the following:

By selecting “Add to cart” from the right-hand menu (a pop-up window will appear indicating that the product has been added to your cart), you will see the product in your cart.

Add the selected product to the basket by clicking on the “Add to basket” button. If you want to add more than one item of a particular product to your basket, change the number field in front of the caption!

If you would like to buy more or less of the selected products, you can even change the quantity column fields on the “Cart” page! After entering the desired quantities, click on the “Update” button!

If you want to delete an item, tick the checkbox next to the product and click on “Update”!

If you want to add other products to your cart, click on the “Continue browsing” button!

If you don’t want to buy any more products, check the number of products you want to buy and click on “Checkout”.

 

You can decide whether you want to register in our online shop. If not, you only need to provide your contact and billing details.

If you do register, we will ask you for a password in addition to the above. As a returning customer, you can also log in here using the details you provided previously – so you don’t have to re-enter your details over and over again, and you can check the status of your orders

As you can have multiple delivery addresses (e.g. home, work), you will need to specify which address you want the current delivery to be made to. You can also enter a new address here. The delivery address can be the same as your billing address, but it can also be completely different.

Select delivery/payment method. Cash on delivery or prepayment, delivery to your home or pick-up.

After checking the details, you can add a comment to your order.

Once you have read and accepted the customer information, click on the “Order” button to send your order!

Select the delivery method. Personal pick-up is only possible at our pick-up point (after placing a pre-order).

After sending your order, we will send you a confirmation by e-mail.

We will also confirm orders received by phone and reconcile the details to avoid any misunderstandings.

It’s important that you enter your details correctly, as this is the only way we can get your parcel to you.

If you do not receive our confirmation e-mail within 48 hours, please check that you have entered the correct address, that our mail has not been sent to your spam folder or that your mailbox is not full.

If you want to change any of the details you entered during registration, you can do so during the registration process or after logging in to the online store.

If necessary, please contact us using the contact details provided in the “Contact” section!

  1. Payment method for the product ordered / delivery to your home

The product ordered is payable on receipt of the parcel. The total amount to be paid includes all costs based on the order summary and confirmation letter. The invoice and guarantee letter are included in the package. We ask you to check the parcel before you receive it and take a report of any damage! We cannot accept any claims without a report!

  1. Home delivery information

Orders placed in our webshop will be delivered as described on our information page. Parcels are delivered by delivery companies during the day on working days. If you are not at the address at the time, the courier will notify you and will try again the next day.

  1. Call for parcel collection

Only order the products you want if you are able to pick up the parcel and pay the invoice amount upon receipt! In the case of returned parcels which are not accepted, the return shipping costs will be charged to the customer according to the terms and conditions set out in the contract.

  1. Availability of a valid contract (invoice)

When the order is fulfilled, we will issue a VAT invoice, which will be given to the customer. Subsequently, the resulting document is not accessible in our webshop. We will keep it in our invoice register until the legally required deadline.

  1. Guarantee

We always include a VAT invoice with our products. We guarantee replacement of our electronic products in case of failure within 3 days. In accordance with the applicable legislation, all new products sold by us, the amount of which does not exceed 10.000 HUF, are subject to a minimum 3-6 months warranty. All our products below 10.000 HUF are covered by a 6 months warranty. All products over 10.000 HUF have a 1 year warranty.

Warranty periods longer than this are marked separately for the products concerned! The warranty period starts on the date of the invoice and the warranty ticket.

 

To avoid problems, please try the product within 14 days of purchase. In the event of product failure, please keep the invoice provided with the product as a warranty letter.

 

We do not guarantee for damages resulting from improper use of the product!

The cost of sending the product to the warranty service point is the responsibility of the customer. You can also return the defective product directly to our webshop at 1051 Budapest, Szent István tér 11. Incorrectly addressed parcels will not be accepted by our acceptance point, they will be returned to the sender in any case!

 

Warranty conditions may vary from product to product, please refer to the relevant legislation:

  1. Right of withdrawal

Pursuant to Government Decree 45/2014 (26.II.) on Distance Contracts, the Customer may withdraw from the purchase within 14 days without giving any reason.

Excerpt from the Government Decree 45/2014 (II. 26.):

The Customer may withdraw from the contract within 14 calendar days without giving any reason.

 

The Customer may exercise his right of withdrawal:

 

The consumer may exercise his right of withdrawal during the period between the date of conclusion of the contract and the date of receipt of the goods.

 

In the case of a written withdrawal by the consumer, it is sufficient to send the notice of withdrawal within 14 days.

 

The consumer must be reimbursed the full price of the product by the trader without delay and at the latest within 14 days.

 

If the consumer does not choose the least costly means of transport other than the usual means of transport, the business is not obliged to reimburse the additional costs incurred in the event of withdrawal.

In the event of withdrawal, the consumer will be charged the cost of returning the product, unless the business has agreed to bear these costs.

 

The business may claim compensation for depreciation resulting from use beyond that necessary to establish the nature, characteristics and functioning of the product.

 

In the case of a contract for the provision of a service, from the date of conclusion of the contract, if the written confirmation required by law has not been received by that date, until 14 days after receipt of the written confirmation, but not more than three months after the date of conclusion of the contract.

 

If the receipt of the written confirmation required by law, or its presentation, takes place within three months of the date of receipt of the product or of the date of conclusion of the contract, the consumer may withdraw within 14 days of that date even if less than 14 days remain from the date of receipt of the product or from the date of conclusion of the contract.

In the case of a written withdrawal, it will be deemed to have been made in time if the consumer sends his statement before the deadline.

 

The consumer shall bear the costs incurred in returning the product as a result of exercising the right of withdrawal. No other costs shall be borne by the consumer.

 

Unless otherwise agreed by the parties, the Customer may not exercise the right of withdrawal provided for by law in the following cases:

 

In the case of a contract for the provision of a service, if the undertaking has begun performance with the consumer’s consent before the expiry of the withdrawal period.

For contracts for copies of sound or video recordings and computer software, if the packaging has been opened by the consumer

 

In the case of a contract for a copy of a sound or video recording or of computer software, if the packaging has been opened by the consumer

 

The right of withdrawal cannot be exercised for used or worn-out products (disposable or hygiene products.

  1. How to exercise the right of withdrawal

If you wish to exercise your right of withdrawal, you may do so in person (1051, Budapest, Szent István tér 11.), in writing by post or by e-mail to https://japanika.hu/uzlet/-ra. If you send your written withdrawal by post by printing out and filling in the “Withdrawal Notice”, the date of posting will be taken into account. If you indicate by post, please make sure to send your indication by registered mail, enclosing the invoice or a copy of it, if possible.

 

Return the ordered product to our address by post or courier service. It is important to note that the costs incurred for the return of the product are the responsibility of the Customer, and our company is not able to accept parcels sent by post (COD)! Please pay special attention to the proper use of the product, as the Customer is responsible for any damages resulting from improper use! After receipt of the parcel by our company, the product will be inspected. Within 14 days after the return of the product, JAPANIKA Hungary Vendéglátó Kft. will refund the purchase price of the product to the bank account number provided by the Customer.

 

  1. Data management

The personal data provided to JAPANIKA Hungary Vendéglátó Kft. during the use of the webshop will be treated confidentially and will not be disclosed to third parties. The only exception to this is the delivery company contracted by JAPANIKA Hungary Vendéglátó Kft, to whom the data necessary for the delivery of the parcel is transferred together with the parcel. While browsing the webshop, technical information may be recorded for statistical purposes only (IP address, duration of visit, etc.). JAPANIKA Hungary Vendéglátó Kft. will only provide this data to the authorities in cases that are legally justified and supported by evidence. The technical information is independent of the data provided during registration or when placing an order, and their correlation will not be verified under any circumstances. The use of the service requires the authorisation of cookies.

If you do not wish to allow the use of cookies, you can disable them in your browser settings. If you disable cookies, you will only be able to use some or all of the service. A cookie is a file sent by our server to the user’s browser and stored on the user’s computer. No personal data is stored in the cookie. The data recorded during the order process is used by JAPANIKA Hungary Vendéglátó Kft. to fulfil the order. The invoice data from the order placed on the webshop’s pages by the individual IT systems are recorded with the data provided during the order placement process and stored for the period specified in the applicable accounting law. You can request the deletion or modification of your data at any time by writing to the customer service e-mail address.

  1. Limitation of liability

Purchasing from the online shop implies that the customer is aware of and accepts the possibilities and limitations of the Internet, in particular with regard to technical solutions and the possibility of errors. Any malfunction in the Internet network that prevents the https://japanika.hu/uzlet/ webshop from functioning properly and from allowing you to make purchases.

Any malfunction of any of the purchasing devices on the communication lines.

Any loss of mail, whether in paper or electronic form, and in particular any loss of data.

Any software malfunction.

The consequences of any program failure, abnormal event or technical error. We are not responsible for any incorrect confirmation letters sent automatically during a system failure.

The https://japanika.hu/uzlet/ webshop is free to change any price or deadline. The change will take effect from the date of publication on the https://japanika.hu/uzlet/ webshop.

The https://japanika.hu/uzlet/ webshop is free to change the terms and conditions of the purchase or the webshop itself at any time, without notice or obligation of any kind (notice, justification). Any modification will take effect from the time it is posted online on the https://japanika.hu/uzlet/ webshop.

By browsing the pages of the webshop and by placing your order, you accept the general terms and conditions of JAPANIK Hungary Vendéglátó Kft. and its data management principles.

The provisions of the Civil Code, the Government Decree No. 45/2014 (26.II.) on distance contracts, and the provisions of Act CVIII of 2001 on certain issues of electronic commerce services and information society services shall apply to matters not regulated in these general terms and conditions.
